How Paternity Is Established Under Oregon Law

Oregon provides three paths to legal paternity, and the right one depends on your circumstances.

The Marital Presumption
A man is presumed to be a child’s legal father if he was married to the birth mother at the time of birth, or if the child was born within 300 days after the marriage ended by death, divorce, annulment, or legal separation. No additional filing is required to trigger this presumption, though it can be challenged under certain circumstances.

Voluntary Acknowledgment of Paternity
Unmarried parents can establish paternity by signing a Voluntary Acknowledgment of Paternity. Depending on when it’s completed, the form is either witnessed by hospital staff at the time of birth or signed before a notary if completed later, and it must be filed with the Oregon Center for Health Statistics. Once filed, it carries the legal weight of a court order establishing the father-child relationship.

Filiation Proceeding
When parents can’t agree, either parent, the child, or the state can initiate a filiation proceeding in circuit court. Oregon courts and the Child Support Program commonly rely on genetic testing in these cases, and a cumulative paternity index of 99 or greater is sufficient under Oregon law to establish paternity.

What Changes Once Paternity Is Established

Establishing paternity does more than assign a legal label. A father has no right to seek custody or parenting time until paternity is legally confirmed. Once it’s in place, that same father gains standing to pursue a custody arrangement and a schedule with the child, and takes on the legal responsibility to provide financial support.

Paternity establishment also allows a legal father’s name to be added to the child’s birth certificate through the acknowledgment process. Oregon law permits a parent to establish parentage at any time before the child turns 18, so the window is long, but waiting can complicate custody and support issues in the meantime.

Challenging or Rescinding a Paternity Determination

The rules differ depending on how paternity was established in the first place.

  • Rescinding a Voluntary Acknowledgment: A signed acknowledgment can be withdrawn within 60 days of filing, without a court proceeding.
  • Challenging a Voluntary Acknowledgment after 60 days: After the rescission window closes, the acknowledgment can be challenged in circuit court, but on grounds of fraud, duress, or a material mistake of fact. The party bringing the challenge carries the burden of proof.
  • Challenging a Court Judgment: A court-ordered paternity judgment can generally be challenged within one year. For a mistake, that deadline runs from entry of the judgment; for fraud, misrepresentation, or other misconduct, it runs from when those grounds are discovered.
